The Client understand the information provided in regards to the details of the property(s) is for my personal use only and will not be disclosed to any third parties without the written permission of EPS.
The Client will not attempt to contact the vendor or agent directly before or after the viewing without the written permission of EPS.
EPS makes no warranty in respect of the property condition (the Client is advised to obtain a full structural survey and legal advice on the purchase) EPS hold no responsibility or liability for the purchase of the property and only provide a sourcing service. Potential rental yields and property values may vary.
The Client agrees to pay EPS the introduction fee of:
up to £125’000 - £1500
£125’001 to £250’000 - £2500
£250’001 to £500’00 - £3500
£500’001 to £1’000’000 - £5000
£1’000’001 to £5’000’000 - £7500
£5’000’001 to £10’000’000 - £10000
ALL fees are payable in full for the purchase of the property at the end of the auction or outright purchase. All fees are payable to Earth Property Solutions (UK) Ltd.
If any of the provisions of this Agreement are found to be unenforceable, the remainder shall be enforced as fully as possible and the unenforceable provision(s) shall be deemed modified to the limited extent required to permit enforcement of the Agreement as a whole.
Description of Services
EPS provides UK property sourcing services, including comparable property information, Financials, local information and expert knowledge (EPS are not liable by the information that’s obtained and provided via the public domain). Furthermore EPS will provide contacts and viewing information allowing the client or its appointed representative to view the properties(s).
Any controversy or claim arising out of or relating to this Agreement, or its breach, shall be settled by arbitration, by one mutually agreed upon arbitrator, in London, UK in accordance with the governing rules of UNCITRAL. Any arbitral award shall be final and not subject to appeal in any manner. Judgment upon the award rendered by the arbitrator may be entered in any court of competent jurisdiction. This arbitration clause does not prevent any Party from requesting interim or conservatory measures from the courts.
Transmission of This Agreement
The transmission of this agreement through Yahoo Messenger, MSN Messenger, Skype, Gmail or any similar programs, tele-fax or e-mail shall be legal and binding.
